Important Laws - Marine Incident Reporting

On January 17, 2006, the Coast Guard expanded the rules for
reporting a marine casualty. Before then, there were four categories
of events that needed to be reported as marine incidents. These
were (1.) the death of an individual, (2.) serious injury to an
individual, (3.) material loss of property, or (4.) material damage
affecting the seaworthiness of a vessel. But with the expanded regs,
“significant harm to the environment” became a category of
reportable marine casualty.

The expanded regs are the result of the Oil Pollution Act of 1990
(OPA 90). With the new regs, foreign flag oil tankers will have to
report casualties occurring within the 200 mile exclusive economic
zone of the U.S., but beyond U.S. navigable waters (3 miles) if the
casualty involves material damage that would affect the
seaworthiness or efficiency of the vessel, or significant harm to the
environment.

What are some of the factors that would need to be considered in
whether something would cause significant harm to the
environment? The ship’s location and distance from land, tidal
conditions, wave heights and other factors related to sea state,
vessel traffic density, and the severity of a vessel’s
unseaworthiness, considering such things as hull integrity and
ability of machinery to remain operating.
