The ship is the tanker Amoco Cadiz. She foundered off the coast of
France on March 16, 1978.
Pacific was the salvage tug that
responded to the stricken tanker. The captain of the salvage tug,
Hartmut Weinert, was negotiating with Amoco over the Lloyd’s Open
Form (LOF). If he performed the job as a salvage operation, he
would have been entitled to a sizeable share of the value of the
Amoco Cadiz and her multi-million dollar cargo. But if he performed
the rescue as a contract-based towing operation, the fee would
have been smaller.

In the end, it didn’t make a difference, because the ship grounded
on the reefs of the coast of Brittany. The grounding resulted in a
major environmental disaster and is said to have been a factor in
the modifications of salvage law in the 1989 International
Convention on Salvage. In salvage law, the rescuer is entitled to a
salvage award if the stricken vessel faces a peril, the rescuer acts
voluntarily and is successful. The idea was to give an incentive to
seafarer’s to come to the aid of their fellow seafarers in a time of
need. The salvor’s (rescuer’s) award would be based upon the
speed with which they acted, their efforts and expenditures, the
perils they faced and other factors. The 1989 salvage convention
(SALCON 89) introduced another factor…  prevention of damage to
the environment. That way, a salvor would be rewarded for
preventing a major environmental disaster as well as saving a
stricken ship.

The day that the
Amoco Cadiz sank was a miserable, wind-swept
day with huge seas. Although the
Amoco Cadiz measured 1095
feet and displaced 230,000, the sea conditions on that day were
enough to bury her nose in the mountainous waves. It was a day
that any commercial mariner would dread, with a steering failure on
the
Amoco Cadiz, a towing cable snapping in the first attempt, and
nothing to save the giant tanker from drifting towards certain
destruction.
